Colombia resignifies and humanizes the concept of justice from the restorative approach

Abstract

In Colombia, the acceptance of restorative justice by the people has not been the best, since for the common people the only way to exercise justice is from a prison structure, so the meaning of the restoration criteria, as they are, truth, justice, reparation and non-repetition, they must be connected to the reality of the country, and give it a new meaning that allows the peace process to be brought closer to the total acceptance of the people, generating trust for both the armed group that is in the process as for the victims. In this article the restorative criteria of justice are analyzed, which imply a series of positive movements by the FARC-ep armed group, such as the cessation of confrontations, the abandonment of weapons, and the demobilization of the armed group, generating this a beginning to a peace process, which is expected by all the Colombian people. Likewise, the most difficult stage of the peace process will be analyzed, which is called post-conflict, since it is necessary to include the demobilized in the civilian population, so it is essential to re-educate the people and generate optimal conditions of inclusion, such as education, employment and housing, since these are essential elements for living together in a community. Accordingly, it is indicated that this article is based on a qualitative research, essentially theoretical, has a descriptive scope, therefore from the conceptual point of view this investigation allowed us to understand that the new concept of restorative justice that Colombia adopts does not consist only of the restoration of the law or the rule of law, or participation and consensus among those involved, but also in the dignification of the victims.
